1. Introduction & Acceptance

These Terms & Conditions ("Terms") govern your access to and use of the Colivelution website located at https://colivelution.ca, together with any associated mobile applications and services (collectively, the "Platform"), operated by Colivelution ("Colivelution," "we," "us," or "our").

By creating an account, browsing listings, submitting an application, or otherwise using the Platform, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, you must not access or use the Platform.

Colivelution connects renters, landlords, and property managers across Canada for the purpose of co-living arrangements. These Terms apply to all users of the Platform, including renters, landlords, property managers, and visitors.

2. Eligibility

To use the Platform, you must be at least 18 years of age and capable of forming a binding contract under applicable law. By using the Platform, you represent and warrant that you meet these requirements and that all information you provide is accurate, current, and complete.

3. Accounts & Registration

You must register for an account to access certain features, including applying to listings, publishing listings, messaging, and membership plans.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You agree to notify us promptly at Info@colivelution.ca if you become aware of any unauthorized use of your account.
Colivelution reserves the right to suspend or terminate accounts that contain false, misleading, or incomplete information.

You may register as a Renter, Landlord/Property Manager, or Business account, and additional terms specific to your account type may apply as set out elsewhere in these Terms.

4. Our Role & the Platform

Colivelution provides a platform that facilitates connections between renters and landlords/property managers. We are not a party to any tenancy agreement, lease, or rental arrangement entered into between users of the Platform, and we do not act as a landlord, property manager, real estate broker, or agent unless expressly stated otherwise.

Colivelution does not guarantee the accuracy, completeness, availability, or legality of any listing, nor does it guarantee that any application, match, or booking will be successful. Users are responsible for independently verifying listing details, property condition, and the identity and legitimacy of other users before entering into any agreement.

5. Listings & Landlord Obligations

Landlords and property managers who publish listings on the Platform agree that they:

Have the legal right to list, lease, or manage the property in question
Will provide accurate, current, and non-misleading information regarding rent, property type, availability, amenities, and photographs
Will comply with all applicable federal, provincial, and municipal housing, tenancy, and landlord-tenant laws
Will not discriminate against prospective renters on any basis prohibited by applicable human rights legislation
Are solely responsible for the terms of any lease, tenancy agreement, or house rules entered into with a renter

Colivelution reserves the right, but is not obligated, to review, verify, edit, refuse, or remove any listing that it believes violates these Terms or applicable law.

6. Renter & User Conduct

By submitting a rental application or communicating with landlords, roommates, or other users on the Platform, you agree to provide truthful information, conduct yourself respectfully, and comply with any house rules, community guidelines, or lease terms applicable to a property you apply for or occupy.

7. AI-Powered Matching

Colivelution uses automated tools and artificial intelligence to suggest properties and potential housemates based on the preferences you provide, such as budget, city, lifestyle, and roommate compatibility. These suggestions are provided for convenience only and do not constitute a guarantee, warranty, or representation of compatibility, safety, or suitability. You are solely responsible for evaluating any suggested match or property before proceeding.

8. Membership Plans & Fees

Colivelution offers Basic, Professional, and Business membership plans, each with different features, listing limits, and pricing as described on our Pricing page.

Fees for paid plans are billed monthly or yearly, as selected at checkout, and are shown in the currency displayed at the time of purchase
Plan features, pricing, and availability may be updated from time to time; material changes will be communicated in advance where required by law
The Basic plan is offered free of charge and may include limited features, such as a standard listing submission active for a limited duration
Paid plans renew automatically at the end of each billing cycle unless cancelled prior to renewal through your account settings

9. Payments, Billing & Refunds

Payments for membership plans and any applicable service fees are processed through our third-party payment processors. By providing payment information, you authorize us (or our payment processor) to charge the applicable fees to your selected payment method.

All fees are non-refundable except where required by applicable law or expressly stated otherwise at the time of purchase
You are responsible for any taxes, duties, or similar charges associated with your purchase
Colivelution is not responsible for rent payments, security deposits, or other funds exchanged directly between renters and landlords outside of Platform-facilitated transactions, except as otherwise described in our Privacy Policy or a specific service agreement

10. Prohibited Activities

When using the Platform, you agree not to:

Post false, misleading, fraudulent, or discriminatory listings or content
Impersonate any person or entity, or misrepresent your affiliation with a person or entity
Use the Platform for any unlawful purpose or in violation of any applicable law or regulation
Attempt to circumvent Platform fees by arranging off-platform transactions initiated through Colivelution introductions, where prohibited by your membership terms
Harvest, scrape, or collect data from the Platform using automated means without our prior written consent
Upload viruses, malicious code, or attempt to interfere with the security or proper functioning of the Platform
Harass, threaten, or discriminate against any other user

11. Intellectual Property

The Platform, including its design, text, graphics, logos, and underlying software, is owned by or licensed to Colivelution and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without our prior written consent.

By submitting content to the Platform (such as a listing, photo, review, or profile information), you grant Colivelution a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content for the purpose of operating and promoting the Platform.

12. Third-Party Services

The Platform may integrate with or link to third-party services, including payment processors, identity verification providers, and social media platforms. Your use of such third-party services is subject to their respective terms and privacy policies, and Colivelution is not responsible for the acts, omissions, or content of any third party.

13. Disclaimers

The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Colivelution does not warrant that the Platform will be uninterrupted, error-free, or secure, and does not warrant the accuracy, completeness, or reliability of any listing, user profile, or AI-generated recommendation.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Colivelution and its officers, directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Platform, any tenancy or agreement entered into with another user, or any dispute between users. In jurisdictions that do not allow certain limitations of liability, some of the above limitations may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Colivelution and its officers, directors, employees, and partners from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of a third party, including in connection with any listing you publish or any tenancy you enter into with another user.

16. Suspension & Termination

We reserve the right to suspend or terminate your account or access to the Platform at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or unlawful conduct, or created risk or possible legal exposure for Colivelution or other users. You may also close your account at any time by contacting us at Info@colivelution.ca. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will continue to apply.

17. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of Canada and the applicable province in which Colivelution operates, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the Platform shall first be attempted to be resolved informally by contacting us; if unresolved, such disputes shall be subject to the exclusive jurisdiction of the courts located in that province.

18. Changes to These Terms

We may revise these Terms from time to time to reflect changes in our services, legal requirements, or business practices. Material changes will be indicated by updating the "Last Updated" date at the top of this page, and, where appropriate, communicated through the Platform or via email. Your continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
